An ex-lawyer has pleaded guilty to a federal obstruction of justice charge for defrauding clients for legal work that prosecutors said he never performed, including preparation of a nonexistent appeal to the U.S. Court of Appeals for the Second Circuit. David Ehrlich, 38, of Cohoes, faces 21 months to 36 months in prison when he is sentenced by Northern District Judge Gary Sharpe (See Profile) on July 29. Under the agreement that led to his March 25 plea in federal court in Albany, Ehrlich promised not to appeal his conviction unless he receives a 27-month or greater sentence.
Ehrlich, also a one-time Albany County assistant district attorney, was disbarred in 2010 based on a series of complaints against him by the Third Department’s Committee on Professional Standards. The misconduct cited included Ehrlich furnishing a client with a phony divorce document purportedly signed by Acting Supreme Court Justice Richard Platkin (See Profile). Court officials showed that Platkin was on duty outside Albany County the day the document was dated and would not have been available to sign it.
