It is now an automatic requirement for attorneys who have been disciplined in other districts to notify the courts in the Eastern or Southern districts. Effective yesterday, Joint Local Civil Rule 1.5 (h) mandates that attorneys who have been suspended, disbarred or censured in another district, court or tribunal report to the clerk’s office in the Southern or Eastern districts within 14 days of the disciplinary action. Lawyers are also required to report whether they have resigned from the bar of any court while an investigation is pending. Failure to comply with the requirement is the basis for discipline in the two New York Districts pursuant to Local Civil Rule 1.5.
