ESTATE OF MAZIL GRANT, Deceased, (2229/08) — Judy Grant Parker (the petitioner), petitions this court for an order directing that Stephanie C. Grant ("Stephanie") attend and be examined with regard to property withheld, to wit; the proceeds of a bank account. Petitioner further requests that Stephanie show cause why she should not deliver to petitioner the proceeds of said bank account. The petitioner alleges that Stephanie coerced the decedent into changing the beneficiaries on her bank account from herself and her brother to Stephanie who then withdrew the proceeds of the account for her own personal use.

The Surrogate’s Court is a court of limited subject matter jurisdiction and possesses those powers conferred on it by statute. SCPA §201. This jurisdiction relates to the affairs of decedents or proceedings regarding the administration of an estate, however, it does not extend “to independent matters involving controversies between living persons.” Matter of Lainz, 79 AD2d 78, 80 (2nd Dep’t 1981).
