ESTATE OF FLORENCE DEMARCO, Deceased (569/12) — In this pending probate proceeding, Florence DeMarco died a resident of Richmond County on April 15, 2012, survived by two children. Her daughter, Diane Cullen, nominated executrix under an instrument dated December 22, 2010, petitioned for probate of that instrument as decedent’s Last Will and Testament.

In the petition, proponent lists her sister, Susan DeMarco, as a person under a disability, alleging her sister suffers from residual affects of brain cancer. Accordingly, the Court designated Paul S. Forster, Esq., pursuant to SCPA 311, as a person to be served with process on behalf of Susan DeMarco. On the return date of Citation, Mr. Forster appeared and advised the Court that following his investigation, he believed Ms. DeMarco required a Guardian ad Litem to protect her interests. The Court then appointed Paul S. Forster, Esq., as her Guardian ad Litem, and Mr. Forster requested an examination of the attesting witnesses to the Will under SCPA 1404.
