The Court of Appeals declined yesterday to grant leave allowing thoroughbred trainer Richard Dutrow to appeal a lower court ruling banning him for 10 years from New York tracks for doping horses. The state high court denied leave in Matter of Dutrow v. New York State Racing and Wagering Board, Mo. No. 2012-1164, without explanation.

Dutrow had asked the court to review a decision last year by the Appellate Division, Third Department, that found “substantial evidence” to support his 2001 suspension by the Racing and Wagering Board. Dutrow, who trained Big Brown to wins in the 2008 Kentucky Derby and the Preakness Stakes, was also fined $50,000.
