A man convicted of killing his fatherthe chief clerk to the presiding justice of the Appellate Division, Third Departmentand attempting to murder his mother is entitled to E-ZPass records of vehicles that passed through various New York State Thruway exits around the time of the attacks, a Brooklyn appeals court has held.
An Appellate Division, Second Department, panel unanimously reversed Supreme Court Justice Michael Melkonian of Rensselaer County as well as the Thruway Authority in holding that the records sought by Christopher Porco are subject to the Freedom of Information Law (FOIL). The court rejected arguments that disclosure of the records would invade the privacy of E-ZPass customers.
