ALBANY - A tenured teacher suspended for sexually harassing “a great number” of girls must be reinstated because the district, as part of an arbitration agreement, waived its right to pursue the only potentially sustainable allegations that would keep him out of the classroom, an appeals panel held yesterday.

The court said that the Unadilla Valley Central School District’s decision to waive “a myriad of appropriate disciplinary charges of general unfitness to teach—such as neglect of duty, immoral character or conduct unbecoming a teacher” so restricted a hearing officer that there was no remaining basis to find the teacher unfit.
