Samuel Boykin, the nephew of the late Brooklyn Civil Court Judge John L. Phillips Jr., has filed a complaint with the office of New York Attorney General Eric T. Schneiderman against Prospect Park Residence, where Judge Phillips died in 2008, alleging the residence falsely claimed to be a licensed assisted-living facility.

Mr. Boykin, the court-appointed administrator of Mr. Phillips’ estate, faxed his hand-written complaint against the residence and its director, David Pomerantz, to Mr. Schneiderman’s office earlier this week. Mr. Boykin claims that Prospect Park Residence marketed itself as a licensed assisted-living facility when in fact it is not one. Mr. Boykin is separately pursuing a wrongful death suit against the residence in which he alleges it failed to provide adequate treatment for Mr. Phillips’ diabetes, contributing to his death.
