ALBANY – A medical malpractice case where the plaintiffs and defendants both missed deadlines and the trial court neglected to follow proper procedures for dismissal has been reinstated in a closely divided opinion by the Court of Appeals.

Cadichon v. Facelle, 205, dates back nearly a decade, when Juliette DeJoie Cadichon suffered complications after surgery and initiated a malpractice action against two hospitals and two doctors.
