ALBANY – New York’s highest court ordered a new trial last week for a man convicted of robbery who had been identified in a photo array by the robbery victim’s son.

Juan Hernandez Sr. was held up at knifepoint in the elevator of his Queens apartment building in 2006. His son, Juan Jr., acknowledged during testimony that he had seen defendant Sebastian Delamota around the Hernandez’s building prior to translating for his father as the father examined photographs of suspects.
