In an exercise of compassion, and over the strong objections of two judges, a Manhattan appellate panel has reduced the plea-bargained sentence of a machete-wielding mentally ill man who inflicted massive injuries on his victim.
A slim majority of the Appellate Division, First Department, invoked its interests of justice authority and slashed to 8 years from 11 years the sentence to be served by Abelino Reyes, 57, for his only offense. The court found that Mr. Reyes was clearly acting out of character and questioned whether the defendant was even capable of forming the requisite intent for second-degree attempted murder.
