A judge overseeing discovery in state lawsuits against Toyota for unintended acceleration has refused to send back one of the cases to its original jurisdiction for trial, saying he would not want the case to precede the trials of two carefully selected federal cases.
Supreme Court Justice Stephen A. Bucaria in Nassau County (See Profile) is presiding over the discovery of 27 suits against Toyota. But attorneys for plaintiff Caterina L. Rimoli, have asked that her case be sent back to Bronx Supreme Court for trial.
