The paid leave for religious observance contained in a Long Island school district’s collective bargaining agreement violates the First Amendment’s establishment clause, a judge has ruled.

After an attorney for the Mineola School District advised the district last year that the practice of offering five days of paid religious observance leave as stipulated in an agreement with the teachers’ union benefitted religiously observant teachers but not non-observant ones, the district discontinued the practice.
