A man convicted under New York's controversial depraved indifference murder statute for shooting his estranged wife to death on a Brooklyn sidewalk has been ordered freed by the U.S. Court of Appeals for the Second Circuit. In writing for the panel, Judge Joseph M. McLaughlin explained that the state Court of Appeals' approach to depraved indifference murder began evolving in 2003, when the court said that certain murders are so "quintessentially intentional" that they cannot be considered depraved indifference murders.
