This Court issued a 57-page summary judgment opinion on December 31, 2003,[1] (“Summary Judgment Opinion”) granting summary judgment on all claims alleged by Plaintiff Christine Hayles, except her assault claim, to Defendants Advanced Travel Management Corporation (“ATM”); Michael Share, the Chairman and CEO of ATM and a managing partner; Christopher Magee, the President and CEO of ATM and a managing partner; Jeanne M. Colachico, an attorney hired by ATM to conduct an in-house investigation; and Morgan, Brown & Joy, LLP (“Morgan Brown”), a law firm retained by ATM. Hayles v. Advanced Travel Mgmt. Corp., 2004 WL 26548 (S.D.N.Y. Jan. 5. 2004). Plaintiff filed a Motion for Reconsideration of the summary judgment ruling on her claim of Intentional Infliction of Emotional Distress, and her Title VII claim of racial discrimination. (Plaintiff’s Memorandum of Law in Support of her Motion for Reconsideration, dated January 22, 2004 (“Pl’s. Mem.”)). Defendant Magee also filed a Motion for Reconsideration of the denial of summary judgment of Plaintiff’s’ assault claim.

For the reasons below, both motions are denied in their entirety.
