New York City’s Health and Hospitals Corporation does not have to reconsider its decision to lay off more than 140 carpenters, electricians and other non-medical personnel, a unanimous appeals panel ruled yesterday in a decision that underscored the city’s power to make personnel decisions without second-guessing by the courts.
Yesterday’s decision by the Appellate Division, First Department, reverses a ruling by Manhattan Supreme Court Justice Alice Schlesinger that blocked the layoffs. Such decisions have become a sore point with executive branch officials, who complain that interference by judges has chipped away at their authority to manage and, in particular, to cope with difficult financial circumstances by cutting personnel (NYLJ, Jan. 24).
