A judge has dismissed a wrongful death action against the contractor that hired a laborer who killed an actress while he was working at the Greenwich Village building where she was killed. The suit was also dismissed against the owner and operator of the building where Adrienne Levine, a 40-year-old writer, director and actress, had an apartment she used as an office. Illegal immigrant Diego Pillco, who had been renovating the apartment below, confessed to the murder and is now in prison.

Ms. Levine’s husband, Andrew Ostroy, brought the wrongful death action against Bradford General Contractors, which employed Mr. Pillco, and its owner, Luis Hernandez. Mr. Ostroy alleged negligence, liability under the theory of respondeat superior and violations of the 1986 Immigration Reform and Control Act. Mr. Ostroy also sued Six Square LLC, saying its owners and managers failed to provide adequate security or reasonable care in hiring a contractor.
