A Staten Island man injured when a dispute over a drinking game turned violent can proceed with his action against the bar where the fight broke out, a state judge has ruled.

Thomas Venito was squaring off against Mark Salverson in a game of “beer pong” at KJ’s Ale House on Staten Island during the 2007 Memorial Day weekend when an argument over the rules turned physical. In the ensuing fight, Mr. Venito sustained facial fractures and an ankle fracture.
