An enjoined party is entitled to a presumption of recovery against an injunction bond if it has been wrongfully restrained, a federal appellate court held Monday.
The decision by a unanimous panel of the U.S. Court of Appeals for the Second Circuit came as the panel asked a lower court to reconsider and clarify its refusal to allow InterDigital Inc. to recover damages against a $500,000 injunction bond posted by rival Nokia Corp. in a patent dispute.
