A Queens judge has applied a new law to vacate prostitution and drug possession convictions after it was proven the defendant was a victim of sex trafficking by her husband.

Criminal Court Judge Toko Serita (See Profile) granted a motion by “G.M.” to set aside her two violations and four misdemeanor convictions under Criminal Procedure Law §440.10(1)(i), passed in August 2010, which authorizes the vacatur of convictions for prostitution and loitering for the purpose of engaging in prostitution if the defendant’s offense “was a result of having been a victim of sex trafficking.”
