A man convicted of stalking his wife as he threatened to kill her has been given a new trial by the U.S. Court of Appeals for the Second Circuit.

The circuit said a lower court erred in letting a jury hear evidence that was highly prejudicial to defendant James Curley, including the circumstances of a 2008 traffic stop in which weapons and Mr. Curley’s “Last Will and Testament” were recovered from the car. The circuit said the stop was too “attenuated” from Mr. Curley’s 2006 stalking of his wife, Linda Curley.
