Eastern District Chief Judge Raymond J. Dearie yesterday strongly suggested that he would deny the motion of an accused terrorist to suppress statements he made to investigators during the 36 hours he was held in custody before being arraigned.

Judge Dearie said that Adis Medunjanin, who is accused of plotting a suicide attack on the New York City subway system, “appeared willing, if not anxious, to speak” to investigators from the Joint Terrorism Task Force. The question of whether the waiver was knowing and voluntary “ends the discussion,” Judge Dearie said.
