A husband who has been sued for divorce may benefit from a 21-year-old prenuptial agreement recently unearthed by his long-time attorney, but he will have to find a new lawyer to represent him in the case, a state judge on Long Island has ruled.

Justice Daniel Palmieri (See Profile) disqualified attorney Jeffrey S. Stephens from representing Edward Scannapieco pursuant to an ethics rule that typically bars a lawyer from acting as an advocate when he is likely to be an issue on a “significant issue of fact.”
