The deliberations of college disciplinary committees are not privileged and are thus subject to discovery in employment discrimination lawsuits against the institutions, a state judge has decided.

In Wander v. St. John’s University, 34854/07, Brooklyn Supreme Court Justice Lawrence S. Knipel (See Profile) ordered the Reverend John H. McKenna to answer questions submitted by two former tenured professors at St. John’s University about the disciplinary recommendations made against the two men by the committee that hears charges against faculty members.
