A Nassau County man arrested and later acquitted of attempted rape can move forward with his false arrest claims against a police detective, a federal judge has ruled.
Eastern District Judge Joseph F. Bianco, sitting in Central Islip, ruled that Nassau County Police Detective Robert Dunn had not established that he had probable cause when he arrested Kevin Houston in 2006 in connection with a suspected attempted rape—a charge Mr. Houston was acquitted of in 2007.
