A federal judge has cleared the way for a jury to decide if Nassau County police used excessive force and wrongfully arrested a Long Island lawyer when they responded to a domestic disturbance call.

“The plaintiff and the defendants tell dramatically different stories of what transpired at 12 Laura Lane on July 18, 2007, and the resolution of this discrepancy is a task reserved for the jury,” Eastern District Judge Arthur D. Spatt wrote in Nimkoff v. Dollhausen, 08-cv-2856.
