A former chief clerk of the Family Court in Syracuse may proceed with her claim that the administrative judge and other officials in the Fifth Judicial District violated her First Amendment rights when they allegedly pressed her to “dish dirt” in 2002 about a Family Court judge who was running as a Democrat for Supreme Court.

Writing for a unanimous panel of the U.S. Court of Appeals for the Second Circuit yesterday, Judge Jon O. Newman concluded that the ex-chief clerk, Bobette J. Morin, is “clearly entitled to proceed to trial” on her claim that the officials had retaliated against her when she opted to steer clear of partisan political activities.
