A state judge has allowed a malpractice case to proceed against a Manhattan law firm accused of filing a late notice of claim against Nassau County only after being alerted to the county’s possible liability in a news article passed along by the client’s mother.
Litman & Litman represented Eric Reisner after the motorcycle he was driving in July 2004 was broad-sided by a car driven by Luis E. Diaz at the intersection of South Oyster Bay Road and Stewart Avenue. The firm sued Mr. Diaz but took no immediate action against Nassau County, which is responsible for maintaining the roads.
