A Brooklyn judge has ordered a trial to determine whether a half-inch facial scar received by a gentleman’s club dancer during a taxi accident constitutes a “serious injury” under New York Insurance Law.
Supreme Court Justice Jack M. Battaglia (See Profile) called the plaintiff’s occupation a relevant factor in determining the significance of the injury and the issue a “matter of aesthetics and culture” best resolved at trial.
