WASHINGTON – The U.S. Supreme Court said judges may award fee enhancements above the “lodestar” amount to lawyers in civil rights cases, but only in rare and well-documented circumstances.

However, the 5-4 majority rejected the fee enhancement in the case before it, Perdue v. Kenny A., 08-970, and sent it back to the lower court with the possibility that, with enough justification, the additional award could be revived.
