A woman injured by falling boxes at a Hamptons toy store has won a new trial in her personal injury suit against the store.

Citing the introduction of “speculative evidence” that someone other than store employees had pushed the boxes off an overstock shelf, Supreme Court Justice Peter H. Mayer in Suffolk County (See Profile) set aside a September 2009 jury verdict in favor of the store and ordered a new trial in Keyser v. KB Toys Inc., 1296-2004.
