Lawyers for the state will ask a Long Island judge tomorrow to dismiss an age discrimination suit brought by a judge seeking reinstatement to the bench after he was forced to retire last December because he had reached the mandatory retirement age.
On Dec. 23, 2009, former Supreme Court Justice William R. LaMarca of Nassau County sued the state, seeking his job back. He claimed his equal protection and due process rights were violated by a state law requiring judges to retire at 70.
