A composer cannot force a private foundation to authenticate two theatrical stage sets he claims are the work of famed American sculptor Alexander Calder, a state appeals court ruled yesterday.

Grammy-award-winning musician Joel Thome contended the Alexander & Louisa Calder Foundation had an obligation to include the mobile sets, which were created for a revival of a 1936 musical production of Erik Satie’s “Socrate,” in a comprehensive listing of more than 17,000 of Mr. Calder’s works.

The owner of this set for “Socrate” asked state Supreme Court to order a foundation to authenticate it as a work by sculptor Alexander Calder.
