A state appeals court has dismissed a suit brought by an elderly resident who claimed the landlord of a “supportive, shared” housing residence did not do enough to address the tenant’s complaints about his ex-roommate’s alleged propensity for violence.

Reversing Civil Court Judge Barbara Jaffe’s (See Profile) award of back rent and more than $8,500 in punitive damages to Ray Cameron, the Appellate Term, First Department, held that the landlord did not breach its covenant of quiet enjoyment or the warranty of habitability when it urged Mr. Cameron to “get along” with his roommate rather than move Mr. Cameron to a comparable apartment.
