PETITIONERS moved for an annulment of respondent commission’s decision directing petitioners to hire an independent auditor for their businesses as a condition of operating same in Westchester County. They alleged the imposition of an independent auditor was in violation of lawful procedure, arbitrary and an abuse of discretion. Respondents argued the decision was the result of a proper exercise of their authority and discretion, and reasonable and proper. The court found Chapter 826-1 700(1) of the county laws clearly authorized the commission to require a licensee to enter into a contract with an independent auditor as a condition of the issuance of the license under the appropriate circumstances. It concluded that based on the circumstances disclosed to the commission— that petitioner’s general manager and vice president were indicted on racketeering charges—justified this action. Thus, petitioners’ application was denied.
