The New York Taxi and Limousine Commission’s policy of suspending taxi drivers’ licenses without a hearing upon their arrest does not violate due process, a federal judge has ruled.

Southern District Judge Richard Sullivan in Nnebe v. Daus, 06 Civ. 4991, rejected the claims of four drivers who were all summarily suspended upon their arrest but were later reinstated when the charges against them were dropped or continued without a finding.
