ESTATE OF KENNETH M. KUPFERBERG, Deceased (6132/C/D/93)—In this proceeding seeking permission of Max Kupferberg to resign as Trustee and to appoint Successor Trustees, petitioner requests that service of process upon two remainder beneficiaries of the Trust be dispensed with by reason of virtual representation (SCPA §315).
Letters of Trusteeship were issued to Max Kupferberg on December 21, 1993 for the Trust created under Article Fifth of the Last Will and Testament of Kenneth M. Kupferberg for the benefit of Anne K. Pepper, as income beneficiary, and her surviving descendants as remainder beneficiaries. Anne K. Pepper’s descendants are her three children: one of whom is an adult and the other two are infants.
