The family of a Long Island woman who was brutally murdered by her neighbor can sue both the killer’s mother and the mental health facility that gave him a weekend pass to visit her, a state judge has ruled.

“Mental health care providers may owe a duty not only to the patient…but also, in certain circumstances, to the public at large,” Supreme Court Justice F. Dana Winslow in Nassau County (See Profile) held in Fox v. Marshall, 14183/08, in declining to dismiss the case.
