MATTER OF THE APPLICATION TO PAY A LEGACY IN THE ESTATE OF PAULINE L. HARRISON, Deceased (3222-2007)—Petitioner, Boyd de Brossard, husband and legatee under the will of Pauline L. Harrison, deceased, seeks the payment of his legacy. The co-executors, decedent’s children, oppose such application pending a determination as to the validity of an alleged Dominican Republic divorce.1
Petitioner admits, contrary to his pecuniary interest herein, that on or before March 11, 1998 he attempted to effectuate a divorce from decedent by signing certain documents which were certified by the Consulate of the Dominican Republic, located in New York City. He alleges that decedent signed a special power of attorney granting jurisdiction to the Judge of First Instance in the Dominican Republic.
