An Albany judge has ordered state Comptroller Thomas P. DiNapoli to restore the pension benefits of a Long Island lawyer who was removed without notice from the pension system last year.

The comptroller revoked Albert D’Agostino’s pension and sought the repayment of $605,874 the lawyer received from August 2002 through March 2008 (NYLJ, Aug. 28, 2008). Mr. DiNapoli said Mr. D’Agostino, of Minerva & D’Agostino in Valley Stream, was improperly listed as an employee, rather than an independent contractor, by several government agencies for periods ranging from three to 23 years.
