An openly skeptical Brooklyn appeals panel yesterday grilled a lawyer for Governor David A. Paterson about the constitutionality of his appointment of Richard Ravitch as lieutenant governor, with one judge calling the move “elitist.”

A four-judge Appellate Division, Second Department, panel relentlessly questioned Kathleen Sullivan, a partner at Quinn Emanuel Urquhart Oliver & Hedges, about the governor’s legal justification for the appointment. And one judge—Justice Thomas A. Dickerson—bluntly rejected her arguments.
