A detective who admitted giving Miranda warnings an hour into an interview with a suspect did not violate the suspect’s privilege against self-incrimination, a state judge has ruled.

In People v. Gardner, 2008 NA 10943, District Court Judge Robert H. Spergel of Nassau County declined to suppress a statement made by Shatara Gardner, who testified that she had been read her Miranda rights at the beginning of her interview, rather than one hour into questioning.
