New York City's second attempt to impose higher fuel mileage standards on its taxi fleet has again been shot down by a federal judge. Southern District Judge Paul A. Crotty yesterday found federal law preempted new regulations designed to increase mileage standards and improve the environment through incentives for the purchase of hybrid vehicles. The city came up with the new incentive program after Judge Crotty in October found that a city-mandated 25-mile-per-gallon minimum by Nov. 1, a number that would increase to 30 miles per gallon by October 2009, was preempted by the national fuel economy scheme.
