Judicial Ethics Opinion 23-224

Although a part-time judge may not serve on a school board, he/she may accept appointment as a community representative to certain advisory committees established by the school board for the local school district: (1) the judge may serve on the district-wide safety team, provided that its work focuses on policies and procedures to promote safety in the schools, and does not involve law enforcement or investigatory functions, and (2) the judge may serve on a citizens finance committee which advises the superintendent and budget officer on annual budget development, capital improvement projects, and the like.

Committee on Judicial Ethics

The Advisory Committee on Judicial Ethics responds to written inquiries from New York state's approximately 3,600 judges and justices, as well as hundreds of judicial hearing officers, support magistrates, court attorney-referees, and judicial candidates (both judges and non-judges seeking election to judicial office). The committee interprets the Rules Governing Judicial Conduct (22 NYCRR Part 100) and, to the extent applicable, the Code of Judicial Conduct. The committee consists of 27 current and retired judges, and is co-chaired by the Honorable Margaret Walsh, a retired justice of the Albany County Supreme Court, and the Honorable Lillian Wan, an associate justice of the Appellate Division, Second Department.
