The New York State Bar Association on Wednesday asked a Manhattan judge to issue a preliminary injunction against New York State, arguing the rate of compensation currently received by assigned counsel outside of New York City is so low as to violate the constitutional rights of those who rely on court-appointed lawyers.

The litigation is led by Michael Dell, a partner at Kramer Levin Naftalis & Frankel. Dell previously secured a pay raise for assigned counsel in the City to $158 an hour.
