Prosecutors in the U.S. Attorney’s Office for the Southern District of New York on Monday urged U.S. District Judge J. Paul Oetken to reject former New York Lt. Gov. Brian Benjamin’s motion to dismiss his indictment, arguing that Benjamin’s attorneys have misstated the standard under which the court should consider quid pro quo agreements.
Benjamin was indicted in April on bribery and fraud charges, with prosecutors saying he obtained a state grant for Harlem real estate developer Gerald Migdol in exchange for campaign contributions.
