Burgos is one of more than 31,000 people who have their DNA on file with the OCME, much of which obtained without warrants or court orders and entered into a suspect index that lacks legislative oversight, according to a proposed class action suit that the New York City Legal Aid Society filed on Monday that names Burgos as a plaintiff.

On Sept. 7, 2019, Shamill Burgos was checking out a friend’s newly purchased ride, sitting in its front passenger seat, when an unmarked New York City Police Department vehicle pulled up behind them.
Two officers emerged and approached the vehicle with hands on their weapons, ordering the occupants to get out. The officers searched the car and found a fanny pack in the trunk containing a gun and Burgos was taken in custody, court papers state.
