A panel of the U.S. Court of Appeals for the Second Circuit appeared poised Thursday to reject a challenge to New York City’s vaccine mandate for education employees, saying there was no path to reviewing the policy under a heightened constitutional standard.

Judges from the Manhattan-based appeals court indicated during oral arguments that city Department of Education officials had a “rational basis” for requiring teachers and other workers to be vaccinated against COVID-19 or be barred from public school buildings.
