Virtual, remote technology and the comfort by the judiciary have come to a point where virtual trials can become more routine and lawyers need to start to embrace this new virtual world. Preparation and practice with the virtual process will result in less “bumpy” trials. Of course, there may be technical issues. However, the alternative to delay a trial until it can be held “in- person” brings to mind the adage “Justice Delayed is Justice Denied.” No longer can counsel claim that they cannot be sufficiently educated to conduct a virtual proceeding or lack comfort with technology as an excuse. Courts see through objections to a virtual trial that are asserted just for delay purposes.
