Todd Bank, the Queens-based attorney who was physically removed from oral arguments at the U.S. Court of Appeals for the Second Circuit in 2019, has lost his appeal in the first case he argued to the court since being publicly reprimanded for “discourteous conduct.”

A three-judge panel of the Manhattan-based appeals court upheld the dismissal Tuesday of Bank’s lawsuit, which targeted the Texas-based utility company Spark Energy over unwanted robocalls.
